    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-402(3) authorizes the Utah State Board of Education (Board) to administer and distribute funds made available through programs of the federal government, and Subsection 53A-1-401(3) allows the Board to adopt rules in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comment has been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides eligibility criteria for new sponsors to recruit participants for child care centers and day care homes in unserved areas. Therefore, this rule should be continued.
