Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
Subsection 53A-17a-107(2) requires the Utah State Board of Education (Board) to adopt a rule requiring a certain percentage of a local education agency's (LEA) professional staff be licensed in the area in which the teacher teaches in order for the LEA to receive full funding under the state statutory formula, and Subsection 53A-1-401(3) which allows the Board to adopt rules in accordance with its responsibilities.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule continues to be necessary because it provides criteria and standards for LEAs to satisfy statutory or federal regulatory percentages of licensed staff. Therefore, this rule should be continued.
