    Subsection 63G-6-207(3) authorizes the Utah Department of Transportation to make rules governing the procurement of highway construction or improvement. Section 63G-6-501 authorizes the Department to adopt rules to use the Construction Manager/General Contractor method of construction contracting management.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Department has not received written comments from interested persons during and since the last five-year review.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Continuation of this rule is needed in order to govern the procurement of highway construction or improvement using the Construction Manager/General Contractor method of construction contracting management.
