This rule is enacted primarily pursuant to Subsection 78A-12-203(7), authorizing rulemaking as necessary to administer judicial performance evaluations. Further, more specific authorization, is provided by Subsection 78A-12-203(3) for courtroom observation; Subsection 78A-12-203(2) for additional relevant evaluation factors; Subsection 78A-12-204(3) for additional classifications of survey respondents; Subsection 78A-12-204((11) to administer the surveys; and Subsection 78A-12-205(3) for additional minimum performance standards.

This rule fills in the detail that is not contained in the statute and allows the reader to more fully understand the entire evaluation process. Therefore, this rule should be continued.
