NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized by Subsection 53-6-105(k). This subsection describes the duties of the director of the Police Academy. This gives the Director the authority to make administrative rules.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments in support or opposing this rule in the last five years.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule defines the basic minimum requirement that allow individuals to make application to Peace Office Standards and Training (POST). These minimum requirements set a standard for who can and cannot be accepted into a POST basic training course. Therefore, this rule should be continued.
