DAR File No.: 26972
Filed: 03/01/2004, 10:07
Received by: NLNOTICE OF REVIEW AND STATEMENT OF CONTINUATION
Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:
The Utah Solid and Hazardous Waste Act, Title 19, Chapter 6, Part 1, establishes the Utah Solid and Hazardous Waste Control Board and gives the Board the authority and responsibility to make and enforce rules to regulate the management of solid waste. For the protection of human health and the environment, the Board is required to make rules establishing minimum standards for the storage, collection, transport, treatment, and disposal of solid waste (Subsection 19-6-105(1)(a)). The Utah Waste Tire Recycling Act, Title 19, Chapter 6, Part 8, gives the Board the authority and responsibility to regulate the collection, transport, recycling, reimbursement for recycling, and disposal of waste tires to reduce the health and safety hazards posed by stockpiles of used tires and to promote the recycling of waste tires.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
Rule R315-320 has been changed several times since the last five-year review was filed on March 12, 1999. Two comments were received during the rulemaking processes to make the changes. A comment was received which suggested that it would be more practical, in the definition of the term "crumb rubber," to establish the size of particles as "equal to or less than 1/4 inch in diameter" rather than "particles that pass through an ASTM Standard 10 mesh." The suggestion was incorporated into the definition. The other comment suggested minor changes in the language of the definition of the term "demonstrated market" which were incorporated into the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
No comments have been received that were in opposition to the rule. Rule R315-320 should be continued since it implements the requirements of the Waste Tire Recycling Act to safely manage the collection, transportation, storage, recycling, and disposal of waste tires in a manner that is protective of human health and the environment.
