NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Section 53A-15-401 places general control and supervision of adult education in the State Board of Education; and Subsection 53A-1-401(3) allows the State Board of Education to adopt rules in accordance with its responsibilities.

No written comment has been received.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is being continued so it does not expire, however, Adult Education Section 353 funding has been discontinued so the rule will be repealed following continuation.
