    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    The rule is required under Section 19-1-206. Specifically, the Department is required to adopt the requirements in Subsection 19-1-206(6). Specifically, the Department is required to make a rule that: 1) establishes requirements and procedures for a contractor to follow to demonstrate compliance with Section 19-1-206, which requires certain contractors to carry health insurance for their employees; 2) specifies how a contractor can establish that it meets the rules by providing a demonstration of "actuarial equivalency"; and 3) describes penalties.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    This is the first five-year review. No comments have been received since the rule was promulgated.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Department is required, under Subsection 19-1-206(6), to promulgate a rule that contains the requirements and limitations in Rule R305-5. Therefore, this rule should be continued. There have been no comments on the rule since it was promulgated.
