    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 19-6-104(1)(j) requires that the Solid and Hazardous Waste Control Board require any facility disposing of non-hazardous waste to submit plans, specifications, and other information required by the Board prior to the construction and/or operation of a facility. Subsection 19-6-108(12) requires that operation plans be reviewed every five years. The rule sets out the procedures and information that must be submitted to review a plan approval and meet the requirements of the statute.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    Proposed changes to the rule were published in December 2011. No comments were received. No comments in support or opposition to the rule were received during the last five-year-review period.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Rule R315-312 provides the standards for operation of recycling and compost facilities that are allowed by the Solid and Hazardous Waste Act. The rule also sets the standards that will assure that these facilities are operated in a way that protects human health and the environment. Therefore, this rule should be continued. Earlier in 2011, there was a rule change which eliminates the requirement that Recycling and Composting facilities be placed on a compliance schedule. All existing facilities have approved plans of operation.
