    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Rule R68-5 is promulgated under Subsections 4-2-2(1)(a)(b) and 4-2-2(4) of the Utah Code. Fees are authorized under Subsection 4-2-2(2). The Department is authorized to promulgate this rule to administer the agricultural laws of the State of Utah and to establish standards for safflower products.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments have been received supporting or opposing this rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Division of Plant Industry requires this rule to establish fees for grain inspection and to establish standards for safflower since there is no federal standard. The standard for safflower provides a basis for fair payment of the grain between a farmer and a purchaser. Therefore, this rule should be continued.
