    Statute authorizes the State Parks Board to regulate water safety on the boating waters of the state in Section 73-18b-1: "The Board of Parks and Recreation may make rules necessary to promote safety in swimming, scuba diving, and related activities on any waters where public boating is permitted."

    No written comments in support or opposition of this rule have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    It is important for public safety that individuals do not swim in areas that are hazardous or frequented by boating traffic. Therefore, this rule should be continued.
