NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Statute authorizes the State Parks Board to exempt certain vessels from registration in Subsection 73-18-9(5): "Registration under this chapter is not required for any of the following: a motorboat or sailboat belonging to a class of vessels which is exempted from registration by the board after the board finds...."

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments in support or opposition of this rule have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

There are certain types of vessels which are impractical to require to register. This rule is necessary to exempt those unique vessels determined by the board not to be required to register. Therefore, this rule should be continued.
