    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 4-2-2 and Subsection 4-2-2(1)(h) direct the Department to establish operational standards for any establishment that manufactures, processes, produces, distributes, stores, sells, or offers for sale any agricultural product, a responsibility that can only be accomplished through rule.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments have been received either supporting or opposing this rule.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule needs to be continued because it defines acceptable practices in the fruit and vegetable packing industry. It also identifies the requirements for being able to sell and market products that are free from pests and other serious defects. This rule enables producers to be competitive in the marketplace.
