    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 466(a)(14) of the Social Security Act requires a state to use automatic data processing to search various state databases to identify the location of the noncustodial parent and his/her assets in response to a request made by another state to enforce support orders. Section 62A-11-305 specifies services that must be provided to another state when a request for "High-Volume, Automated Administrative Enforcement" is received.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule needs to be continued because it provides and establishes procedures for the Office of Recovery Services to provide services to other state IV-D child support agencies requesting High-Volume Automated Administrative Enforcement. It also describes that automated administrative interstate enforcement request are given the same priority as a regular interstate case that is referred to the office by another state for collection services, or establishment, modification, or registration of an order. Upon review of this rule, the department notes that this rule needs to be amended to add a citation containing the statutory rulemaking authority for the office which will be done soon.
