    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 4-3-2 gives the Utah Department of Agriculture and Food, Division of Regulatory Services, the authority to inspect all frozen dairy foods and frozen dairy food mixes sold, bought, processed, manufactured, or distributed within the State of Utah.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    There have been no written comments received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    It is the judgment and discretion of the department that this rule is necessary to carry out the purpose of Title 4, Chapter 3, the Utah Dairy Act. Therefore, this rule should be continued.
