Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Sections 77-27-5, 77-27-6, 77-27-9, 77-27-10, and 77-27-11 define the Board's authority, payment of restitution, parole hearing proceedings, conditions of parole, and revocation of parole. Rule R671-402 allows the Board the ability to add special conditions to a standard parole agreement.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The Board supports the continuation of this rule because if it feels that special conditions are in the best interest of the public, the Board should be allowed to implement those conditions to a parole agreement.
