    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 26-1-5 grants the Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. Section 26-18-3 requires the Department to implement the Medicaid program through administrative rules. In addition, 42 CFR 435.840 requires a Medicaid agency to use a single resource standard for each group.

    No written or oral comments have been received regarding this request.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule is necessary because it establishes resource criteria to become eligible for Medicaid. Specifically, it establishes resource standards for the evaluation of assets to determine eligibility for categorically and medically needy Medicaid clients. Therefore, this rule should be continued.
