NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Statute authorizes the State Parks Board to promulgate rules relating to collection of charges as follows: "2) The board shall adopt appropriate rules governing the collection of charges under Subsection 79-4-203(8)." Subsection 79-4-203(8)(a) states: "The division may make charges for special services and use of facilities, the income from which is available for park and recreation purposes."

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments that specifically support or oppose the Division's fee schedule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

It�s imperative that this administrative rule be approved because the Division of Parks and Recreation relies on the revenue generated through the fee schedule to operate parks, maintain facilities, offer recreational experiences, and administer the boating and off highway vehicle programs. Therefore, this rule should be continued.
