NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Sections 63G-3-201 and 64-13-10 which allow the Department to adopt standards and rules in accordance with its responsibilities. The purpose of this rule is to provide the Department's policy and procedures governing offenders' access to and use of telephones.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This administrative rule and Department policy help to ensure community correctional centers' telephones are used for authorized purposes, and that staff may listen to the offender's conversation, with the exception of calls made to legal counsel. Therefore, this rule should be continued.
