    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    In Section 4-3-2, the department is authorized and directed, subject to Title 63G, Chapter 3, the Utah Administrative Rulemaking Act, to make and enforce such rules as may in its judgment and discretion be necessary to carry out the purposes of this chapter. The department determined that requirements for milk testers were needed to assure accuracy of testing results for the good of the milk industry and the consumer.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No comments supporting of opposing this rule have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The department has determined that the requirements are still needed to assure accuracy of testing results for the good of the milk industry and consumer. Therefore, this rule should be continued.
