Subsection 53A-1-403(1) makes the Utah State Board of Education directly responsible for the education of youth in custody; and Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities.

This rule continues to provide standards and procedures for education of youth in custody. The requirements in the rule continue to be necessary for the administration and funding of the program. Therefore, this rule should be continued.
