The Legislature has granted the Labor Commission the authority to set the premium rates to fund the Employers Reinsurance Fund, the Uninsured Employers' Fund and the workplace safety account, for each calendar year as set forth in Section 59-9-101 and Title 34A, Chapter 2.

No written comments have been received during and since the last five-year review of this rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
The Legislature has not changed the law which grants the Labor Commission the responsibility to set the premium rates. The funds that the premium rates fund are still needed to assist workers in the state, therefore, this rule should be continued.
