    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-401(3) allows the State Board of Education to adopt rules in accordance with its responsibilities, and Section 53A-1-403.5 makes the State Board of Education responsible for the education of inmates in the custody of the Department of Corrections.

    No written comments have been received.

     

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The law continues to make the State Board of Education responsible for the education of persons in the custody of the Department of Corrections, therefore this rule should be continued.
