    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 26-2-8 provides for rules to be developed governing the registration of births that have not previously been registered within time limits required by law. Sections 26-2-14.1 and 26-2-14.2 provide the same for births resulting in stillbirth.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Rule R436-4 establishes procedures and standards for documentary evidence for delayed registration of births and deaths. These procedures and standards are necessary to allow for registration of delayed events while preventing fraudulent registrations. Therefore, this rule should be continued.
