Federal law requires that the Department establish a public hearing process for all projects that receive federal funds, see 23 CFR 771. This rule establishes that process.

None have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The department still needs to involve the public via a public hearing process and this process works well. Therefore, this rule should be continued.
