Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Subsection 19-5-104(1)(f) authorizes the Utah Water Quality Board to adopt rules to implement awarding construction loans to political subdivisions and municipal authorities under Section 11-8-2. The authority for the Department of Environmental Quality acting through the Utah Water Quality Board to issue loans to finance all or part of wastewater project costs from the State Revolving Fund (SRF) is provided in Title VI of the Federal Clean Water Act and Section 73-10c-1.

No comments have been received during the last five-year review period for the rule.

 

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule establishes policies and procedures for implementing the Utah SRF Program. The rule contains definitions, eligibility requirements, and application procedures, and prioritization procedures central to the Water Quality Board's implementation of their statutory charge; and should be continued.
