Under Sections 23-14-18 and 23-14-19, the Wildlife Board is authorized and required to provide rules to regulate and prescribe the means by which protected wildlife may be taken.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
Any comments received in opposition to the rule are resolved using existing policies and procedures or the issue is placed on the Regional Advisory Council's and Wildlife Board's agenda for review and discussion during the process for taking public input. The public is welcome to view the Regional Advisory Council minutes, the Wildlife Board minutes, and the administrative record for this rule at the Division of Wildlife Resources. Changes made since the last five-year review include things such as amendments to clarify definitions, reporting requirements, simplify application deadlines, and add requirement provisions for program participants who are members of the United States Armed Forces or public health or public safety organizations. Also added was a provision that participants entering or reentering the program in 2003 and would be subject to any changes subsequently made in the program during their three-year term of enrollment, including alteration or elimination of the opportunity to hunt multiple seasons or to receive a general buck deer permit in a region of choice. Other changes were made to add consistency and clarity to the rule.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
Rule R657-38 provides the procedures, standards, and requirements applicable to the dedicated hunter program. The provisions adopted in this rule are effective in providing the standards and requirements for administering the dedicated hunter program. Continuation of this rule is necessary for continued success of the program.
