Subsection 19-5-104(1)(a) authorizes the Utah Water Quality Board to adopt rules to implement awarding construction loans to political subdivisions and municipal authorities under Section 11-8-2. The authority for the Department of Environmental Quality acting through the Utah Water Quality Board to issue loans to finance all or part of wastewater project costs from the State Revolving Fund (SRF) is provided in Title VI of the Federal Clean Water Act and Section 73-10c-1.

This rule establishes policies and procedures for implementing the Utah Wastewater SRF Program. The rule contains definitions, eligibility requirements, types of financial assistance provided, and funding priorities that are central to the Water Quality Board's implementation of their statutory charge. Therefore, this rule should be continued.
