    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Title 26, Chapter 21, is the health code that mandates the licensing of health facilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    There have been written comments in regards to amending the statute and this rule so the current unlicensed birthing centers would be able to comply and become licensed. Birthing centers have a difficult time complying with the rule requirement of having either a transfer agreement with a hospital or having a physician with admitting privileges at a hospital. These providers agree the rule should be continued.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Bureau has and will continue to work closely with the Health Facility Committee and the birthing centers in regards to amendments to the birthing center rule. This rule continues to be required by Title 26, Chapter 21, of the Health Facility Licensure and Inspection Act. The Department agrees with the need to continue the rule.
