    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 63G-3-101 et seq. requires agencies to make rules under certain circumstances and specifies procedures for state agencies when making rules, and Subsection 53A-1-401(3) authorizes the Utah State Board of Education to make rules in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    State law continues to require that the State Board of Education make rules and Rule R277-100 provides procedures for the rulemaking process. Therefore, this rule should be continued.
