Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

Title 34A, Chapter 6, establishes the Utah Occupational Safety and Health Division. For the purposes of 1) preserving human resources by providing for the safety and health of workers, and 2) providing a coordinated state plan "as effective as" the Federal OSHA program, Subsection 34A-6-105(1)(c) authorizes the Labor Commission to make all necessary and reasonable rules to implement Title 34A, Chapter 6.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received during or since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This specific rule establishes definitions, incorporates federal standards, establishes other basic safety rules, and addresses inspections, confidentiality of information, and penalties. This rule remains necessary to implement the legislative intent underlying enactment of the Utah Occupational Safety and Health Act, set forth in Section 34A-6-102, of providing for the safety and health of workers and establishing a coordinated state plan as effective as the federal Occupational Safety and Health program. Therefore, this rule should be continued.
