This rule is authorized under Section 26-1-5 which grants the Utah Department of Health the power to adopt, amend, or rescind rules that shall have the force and effect of law. In addition, this rule is authorized under Section 26-18-3, which requires the Department to administer the Medicaid program. Furthermore, 42 CFR 440.60 authorizes medical care or any other type of remedial care provided by licensed practitioners.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule should be continued because it provides podiatry services that diagnose, treat and correct foot ailments and improve the quality of foot care to eligible Medicaid recipients.
