Section 53C-1-304 requires the Board of Trustees for the School and Institutional Trust Lands Administration (SITLA) to establish due process rules for the resolution of conflicts regarding actions taken by the board, director, and the agency. This rule provides the procedures for aggrieved parties to petition for administrative or judicial review of the actions taken.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comments have been received by the agency concerning this rule since the previous five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

There continues to be a need for a mechanism for aggrieved parties to petition for redress of agency or board actions which affect an interest held by the parties. This rule provides for a reasonable and effective way for the board to address challenges to agency and board actions. Therefore, this rule should be continued.
