NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is enacted under Sections 72-3-102 and 72-7-102 to provide a procedure for installation of new mailboxes and for the correction of nonconforming mailboxes.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

There have been no written comments from interested persons received during and since the last five-year review.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

The law requiring the department to maintain and control state highways remains in force, and the department complies with the law by having this rule to regulate the installation of new mailboxes and the correction of nonconforming mailboxes. Therefore, this rule should be continued.
