This rule is enacted under the authority of Section 72-9-301 of the Motor Carrier Safety Act which directs the department to enforce the Federal Motor Carrier Safety Regulations as contained in Title 49, Code of Federal Regulations, and under Section 72-9-103 which directs the department to make rules adopting the Federal Motor Carrier Safety Regulations.
Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:
There have been no written comments from interested persons received during and since the last five-year review.
Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:
This rule adopts regulations for the safe operation of motor carriers. The continuation of this rule ensures the safety of motor carrier companies operating in the state and continues to protect the motoring public. Therefore, this rule should be continued.
