Section 34A-5-104 gives the Labor Commission authority to establish rules to administer and enforce the Utah Antidiscrimination Act. To assist employers in avoiding discrimination, the Labor Commission has established a guide for pre-employment actions and inquiries.

The Labor Commission continues to have jurisdiction over discrimination in the workplace. This rule establishes a guide for employers and employees in pre-employment situations, to help them avoid discriminatory acts. Therefore, this rule should be continued.
