    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsections 26-1-30(2)(a), (b), (d), (e), and (g) and Section 26-3-8 delegate powers to the Department of Health to undertake activities to improve the health of the public.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Concern over patient safety in medical care continues to grow with the Centers for Medicare and Medicaid Services Pay for performance, the Center for Disease Control focus on hospital acquired infections, and medication errors. This rule is necessary to focus the industry on statewide interventions, to provide state wide surveillance, and to assure statewide accountability. Therefore, this rule should be continued.
