    Subsection 63G-4-202(1) authorizes agencies to designate categories of adjudicative proceedings as informal. It further authorizes agencies to make this designation by rule.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    Although the Division rarely engages in administrative hearings, it is imperative that the rule be in place for just such a circumstance. Therefore, this rule should be continued.
