NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

The purpose of this rule is to establish the policy of the Utah State Building Board relative to projects which are funded partially or totally by non-appropriated funds; and establish requirements for verification of funding and the timing of reimbursements to the Division of Facilities Construction and Management (DFCM) for expenditures made. This rule is authorized under Subsection 63A-5-103(1)(e), which directs the Building Board to make rules necessary for the discharge of the duties of DFCM.

No comments have been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule is necessary in order to establish the policy concerning verification of funding and timing of reimbursements to DFCM for Capital Project expenditures. It also provides clarification concerning purpose, authority, and background. Therefore, this rule should be continued.
