Sections 53A-1-603 through 53A-1-611 direct the Utah State Board of Education (Board) to adopt rules for the maintenance and administration of U-PASS and Subsection 53A-1-401(3) allows the Board to adopt rules in accordance with its responsibilities.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No written comment has been received.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule continues to be necessary because it provides standards and procedures for a Board-developed and directed comprehensive assessment system for all students as required by state and federal law. Therefore, this rule should be continued.
