    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-6-303(1)(a) directs the Utah State Board of Education (Board) to adopt rules establishing procedures for nominating and appointing Utah Professional Practices Advisory Commission (UPPAC) members and Subsection 53A-1-401(3) allows the Board to adopt rules in accordance with its responsibilities.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because the rule establishes nomination and appointment procedures for UPPAC members as required by law. Therefore, this rule should be continued.
