    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Section 35A-1-104 authorizes the Department of Workforce Services to adopt rules. Subsection 35A-1-104(4) authorizes the Department to establish eligibility standards for its programs. Authority to make rules to establish eligibility for Family Employment Program (FEP) is found in Subsection 35A-3-302(5)(b). The FEP is authorized by the state legislature and funded primarily by the federal government. The Department is authorized to establish eligibility criteria and rules for the program.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    The Department has not received any written comments since the last five-year review.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The rule is necessary to establish eligibility and rules for FEP and other Temporary Assistance for Needy Families (TANF)-funded programs. Without this rule, clients and the Department would not know when a client is eligible, how to determine the amount of the payment, and what a client must do to remain eligible. Therefore, this rule should be continued.
