    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-401(3) allows the Utah State Board of Education to adopt rules in accordance with its responsibilities, and Section 53A-11-1003 directs the Utah State Board of Education to adopt rules governing the dissemination of information about violent juvenile offenders in the public schools.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides procedures for school districts and charter schools to follow in notifying school personnel of violent offenders in their schools. Therefore, this rule should be continued.
