Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is promulgated under Subsection 4-2-2(1)(i) and Section 4-1-3.5 to comply with the Title 63G, Chapter 4, the Administrative Procedures Act. Additionally, Section 4-2-12 allows the department to initiate actions against a person or firm that may be in violation of any code provisions.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received by the Department since the last five-year review of the rule.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

This rule establishes and governs the administrative proceedings of the Utah Department of Agriculture and Food and is required in order for the Department to accomplish this administrative function. Therefore, this rule should be continued.
