    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Promulgated under authority of Title 4, Chapter 5. The purpose of this rule is to set forth requirements and controls for vending machines designed to dispense water intended for human consumption to assure: 1) consumers using such machines are given appropriate information as to the nature of the vended water; 2) the quality of the water vended meets acceptable standards for potability; and 3) the vending equipment is installed, operated, and maintained to protect the health, safety, and welfare of the consuming public.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comments have been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    The Utah Wholesome Food Act is in place to protect the public from adulterated food and water products. This rule needs to continue in order to protect the public from contaminated vended water.
