Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

This rule is authorized pursuant to Section 54-8b-2.2 which requires the commission to make rules to implement the competitive provision of facilities-based intraLATA toll and local exchange services and to adopt rules which implement the competitive provision of facilities-based intraLATA toll and local exchange services. This rule is required to address those issues the commission determines are essential for a competing telecommunications corporation to provide intraLATA toll and local exchange services and necessary to protect the public interest, including the interconnection with essential facilities and the purchase and sale of essential services of telecommunications corporations authorized to provide public telecommunications services in the same or overlapping service territories on a nondiscriminatory and reasonably unbundled basis.

Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

No comments have been received in the last five years. An amendment was made to the rule in May 2005 to eliminate references for activities which have already occurred and to update terminology. The amendment became effective in June 2005.

Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

Section 54-8b-2.2 requirements continue to authorize this rule for the reasons stated in the "concise explanation of the particular statutory provisions" above and therefore, this rule should be continued.
