    NOTICE OF REVIEW AND STATEMENT OF CONTINUATION

    Concise explanation of the particular statutory provisions under which the rule is enacted and how these provisions authorize or require the rule:

    Subsection 53A-1-402(1)(b) directs the Utah State Board of Education (Board) to establish rules and minimum standards for access to programs. Section 53A-2-210 directs the Board to provide a formula by rule for resident students who attend school districts under Section 53A-2-206.5 et seq.

    Summary of written comments received during and since the last five-year review of the rule from interested persons supporting or opposing the rule:

    No written comment has been received.

    Reasoned justification for continuation of the rule, including reasons why the agency disagrees with comments in opposition to the rule, if any:

    This rule continues to be necessary because it provides standards and procedures for Utah public school statewide open enrollment. Therefore, this rule should be continued.
